In re Sony PS3 "Other OS" Litigation3:10-cv-01811 (N.D. Cal.) March 2014
Hausfeld LLP is court-appointed co-lead counsel in a nationwide class action in the Northern District of California on behalf of Sony Playstation 3 (PS3) purchasers. One fo the key distinguishing features of the PS3 that Sony advertised and promoted was the PS3's "other operating system" function, which allowed users to install Linux and use the PS3 as a computer. Sony unilaterally decided to cancel this important PS3 feature through a firmware update leaving millions of purchasers without the ability to access the PS3 computer mode, yet providing no compensation or refunds to impacted purchasers. The class has asserted claims under California law for unfair competition and the Consumer Legal Remedies Act, among others.
While the case was initially dismissed by the District Court, that decision was reversed by the Ninth Circuit Court of Appeals. The case is now in active litigation.
