Arthur N. Bailey, Jr.
Mr. Bailey is a partner in the San Francisco office. He represents consumers and businesses in antitrust litigation and other complex litigation matters. Areas of practice include technology, automotive and agricultural industries, and sports and entertainment.
The multidistrict antitrust matters Mr. Bailey has worked on include In re Aftermarket Automotive Lighting Products Litigation, MDL 2007 (C.D. Cal.), a case alleging a conspiracy by automotive manufacturers to fix prices of aftermarket auto lights and lamps (pending settlements in aggregate over $50 million); In re Fresh and Process Potatoes Antitrust Litigation, MDL No. 2186 (D. Idaho), alleging price fixing and supply reduction conspiracy in the potato industry; In re Blue Cross Blue Shield Antitrust Litigation, MDL No. 2406, (N.D. Al.), alleging a scheme by Blue Cross Blue Shield to restrict competition and fix prices in the health care insurance industry; and In re Rail Freight Fuel Surcharge Antitrust Litigation, MDL No. 1869 (D.D.C.), alleging price fixing of rail freight fuel surcharges by the nation's dominant freight-shipping railroads.
Other cases Mr. Bailey has worked on include Bruce Foods Corporation vs. SK Foods, LP. et al., (E.D. Cal.), alleging a conspiracy by processors to fix prices of processed tomato products and In re Student-Athlete Name & Likeness Licensing Litigation (N.D. Cal.) a case alleging antitrust violations by the NCAA and its member schools involving the commercial use of the likenesses of its student-athletes. Mr. Bailey also represents musicians in several class actions seeking to compensate recording artists for unpaid royalties from their record labels for sales of digital downloads.
Mr. Bailey has also represented the California Teachers' Association and the National Education Association in litigation in the Ninth Circuit Court of Appeals and the United States Supreme Court, authoring amicus curia briefs on their behalf in support of the right of gays and lesbians to marry.
Prior to joining the firm, Mr. Bailey was an attorney at Cohen, Milstein, Hausfeld & Toll, PLLC, as a member of its antitrust practice group. He also was employed at Kaplan Fox & Kilsheimer LLP where he worked on antitrust, securities fraud and consumer fraud class action cases.
